Short and in plain language. Where it has to be legally precise, it is.

1. Who and what

MoshMate is operated by Matthew Mc Gregor, Eckertstraße 30m/17A, 8020 Graz, Austria. The full provider details are in the Imprint.

MoshMate is a diary of concerts you have been to. You write down where you were; from that come your profile and public pages about concerts, bands and venues.

MoshMate is explicitly not a dating, partner or contact service. There is no people search, no user list and no arranging of company. Who meets who is up to the evening.

2. Account

To add entries you need an account with an email address and a password. Your details must be accurate, and the account is personal: do not pass the credentials on.

You must be at least 16. If you are younger, you need your guardians' consent.

You can delete your account yourself at any time, with no notice period and no reason given, under Settings.

3. Your content

What you write down stays yours. Notes, ratings and photos belong to you.

So that MoshMate can show them at all, you grant us a non-exclusive, worldwide, royalty-free right to store your content within the service and display it at the visibility you chose. That right ends when you delete the content or your account.

Your notes are stored verbatim and are never rephrased automatically or overwritten by a machine.

Only upload photos you took yourself or hold the rights to. Only upload photos in which other people are recognisable if that is alright with them.

4. What is not allowed

Prohibited: unlawful content, insults, threats, harassment, incitement against groups, advertising and spam, false concert details, impersonating other people, and automated harvesting of the pages on a scale that disrupts operation.

Also prohibited is trying to locate or follow anybody through MoshMate. That is exactly why the day signal shows only a number and never names.

In case of a breach we may remove or restrict content and, on repetition, suspend the account. How that works is set out under How reports are handled. How reports are handled.

5. Reporting and moderation

There is a Report button on every piece of content. Reporting is free and is never restricted, and so are blocking, deleting and the data export. Every report is looked at by a person and every decision is given reasons. The procedure has its own page. How reports are handled.

6. Cost

Use is free. Adding entries is never capped, neither by a paywall nor by a quota.

You may voluntarily take out a supporter subscription. What is stated on the subscription page applies to it, including the right of withdrawal. You can cancel at any time with the cancellation button. MoshPit Pro · Cancel your subscription.

7. Availability

MoshMate is run by one person on the side. We try to keep it running, but we do not owe any particular availability. Maintenance, faults and outages are possible. Download your data export if your collection matters to you; it is free and always available.

8. Liability

We are liable without limitation for intent and gross negligence, and for damage arising from injury to life, body or health.

For ordinary negligence we are liable only for breach of an obligation whose fulfilment makes proper performance possible in the first place and on whose observance you may regularly rely, and limited in amount to the foreseeable damage typical for this kind of contract.

Liability is otherwise excluded. Mandatory statutory liability, product liability law in particular, is unaffected.

We give no warranty for content posted by users or for concert data from external sources. Dates can be wrong or duplicated; check with the promoter before travelling.

9. Changes to these terms

We may change these terms where there is an objective reason, such as new features or a change in the law. We will tell you about changes by email at least six weeks in advance. If you do not object before they take effect, they count as accepted; we point that consequence out in the message. If you do object, you can terminate before then.

10. Law and jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer, the following applies in addition: this choice of law does not deprive you of the protection of mandatory provisions of the state in which you are habitually resident. You may also sue us where you live, and we may sue you only there.

Should any provision be invalid, the rest remains in force.
